This Privacy Policy explains how information about you is collected, used and disclosed by Message Digital, LLC ("Message"). This Privacy Policy applies to personal information we collect when you use our website located at messagedigital.com (the “Site”) and any other Message services that we provide from time to time (collectively, the "Services"). This Privacy Policy also applies to your personal information that we have acquired, by license or ownership, from third parties.
We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you an email notification). COLLECTION OF PERSONAL INFORMATION

Data that has been deidentified or that otherwise cannot reasonably be related back to a specific person is not considered personal information.

Personal Information We Obtain From Third Party Sources

We may also use such personal information for list matching purposes.

- Monitor and analyze trends, usage and activities in connection with the Services;
- Detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of Message and others;
- Link or combine your personal information with information we get from others, including to augment our Prospecting Audience Services; and
- Carry out any other purpose for which the information was collected.
We reserve the right to supplement your personal information with information we gather from other sources which may include online and offline sources. We may collect information that is not personal information (“non-personal information”), including anonymous or aggregate data, or information lawfully made available from federal, state, or local government records. Because non-personal information does not personally identify you, we may collect, use, and disclose such information for any purpose permitted by law. In some instances, we may combine non-personal Information with personal information. If we combine any non-personal information with personal information, the combined information will be treated by us as personal information to the extent that it is capable of personally identifying you. We reserve the right to develop and derive aggregate data (meaning information that relates to a group or category of individuals, from which individual identities have been removed) from personal information in order to enhance and maintain the Services, and such aggregate data will be treated as non-personal information.
We are based in the United States and the personal information we collect is governed by U.S. law. By accessing or using the Site or otherwise providing personal information to us, you consent to the processing and transfer of information in and to the U.S..
SHARING OF PERSONAL INFORMATION
We may share personal information about you as follows:
- Data Broker Services. Please be aware that Message is a data broker. We buy, sell, and license the sale of personal information. As a data broker, we reserve the right to transfer your personal information to another person or entity, with or without consideration, unless you opt-out as described below in the “Your Privacy Rights” section, or unless barred by applicable law.
- Third-Party Service Providers. We share personal information with vendors, consultants and other service providers who need access to such information to carry out work on our behalf;
- Business and Advertising Partners. With third parties who partner with us to promote products and services, provide marketing and advertisements, conduct data analytics, or use the data for other commercial purposes. We do not control how these third parties use and share your personal information once they receive it. You will need to contact such third parties directly for information about their privacy practices or to exercise any rights you may have (including if you would like to opt-out of marketing messages);
- Legal Requirements. When we believe in good faith that we are lawfully authorized or required to do so or that doing so is reasonably necessary or appropriate to comply with the law or legal processes or respond to lawful requests, claims or legal authorities, including responding to lawful subpoenas, warrants, or court orders;
- To Prevent Harm. If we believe your actions are inconsistent with the spirit or language of our user agreements or policies, or to protect the rights, property and safety of Message, its employees, or others;
- Business Transfer. In connection with, or during negotiations of, any reorganization, formation of a new successor organization, asset sale or transfer, financing or lending transaction, or in any other situation where personal information may be disclosed or transferred as one of the assets of Message; and
- Aggregated Data. We may also share non-personal information that is aggregated or anonymized, which does not directly identify you.
ADVERTISING AND ANALYTICS SERVICES PROVIDED BY OTHERS
We may allow others to serve advertisements on our behalf across the Internet and to provide analytics services. These entities may use cookies, web beacons and other technologies to collect information about your use of the Site and other websites, including your IP address, web browser, pages viewed, time spent on pages, links clicked and conversion information. This information may be used by Message and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Site and other websites and better understand your online activity.
For example, we use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help analyze how users use the Website. The information generated by these cookies about your use (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Website, compiling reports on activity for its staff, and providing other services relating to web page activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. You may refuse the use of cookies by selecting the appropriate settings in your browser. By using the Website and accepting cookies, you consent to the processing of data about you by Google in the manner and for the purposes set out above. - DoubleClick Platform Integration
This enables Google, to show our ads on sites across the Internet. We, along with third-party vendors such as Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimize, and serve ads based on your past visits to our Site and other sites and to compile data regarding user interactions with ad impressions and other ad service functions as they relate to our website.
Users can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising initiative opt out page or permanently using the Google Analytics Opt Out Browser add on.

DATA RETENTION
How long Message retains personal information depends on the type of information and the purpose for which it was collected. Message will retain personal information collected through the Site for as long as your inquiry is active or as needed to provide you with our services, and for a reasonable time thereafter in accordance with our standard procedures or as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements. For personal information that Message collects through other Services, or from third party sources as described in this Privacy Policy, Message may, subject to applicable law, retain such information indefinitely. Even if we delete some or all of your information, we may continue to retain and use anonymous or aggregate data, or any other data that constitutes non-personal information. Please note that we will not be liable for disclosures of your data due to errors or unauthorized acts of third parties.

Message takes reasonable measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. We prioritize the protection of confidential materials, access credentials, and personally identifying information through robust policies. YOUR CHOICES
Consistent with applicable law, you may exercise the choices described in this section regarding your personal information and communications from us. You may also have certain additional rights available depending on laws in your state or country of residence, as described further below in the Privacy Policy.
Cookies

YOUR PRIVACY RIGHTS
U.S. State Privacy Rights
If you are a resident of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, New Hampshire, Delaware, Iowa, Nebraska, New Jersey, Tennessee, Minnesota, Maryland, or another state with a similar data privacy law (collectively, “Covered States”), you may have specific rights regarding your personal information under the California Consumer Privacy Act (“CCPA”), Virginia Consumer Data Protection Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, Texas Data Privacy and Security Act, Oregon Consumer Privacy Act, Montana Consumer Data Privacy Act, New Hampshire Data Privacy Act, Delaware Personal Data Privacy Act, Iowa Consumer Data Protection Act, Nebraska Data Privacy Act, New Jersey Data Protection Act, Tennessee Information Protection Act, Minnesota Consumer Data Privacy Act, Maryland Online Data Privacy Act, and similar laws in other U.S. states (collectively, “State Privacy Laws”). Information We Collect; How We Collect It; How We Use It
General information regarding our collection, use, and disclosure of personal information is set forth in the Privacy Policy above.
In the past 12 months, we have collected categories of personal information, from the sources described in the section of the Privacy Policy above titled “Collection of Personal Information”. Depending on your level of interaction with us, we may not have collected your personal information from all of the categories listed in the Privacy Policy above. We collect and use your personal information for the business or commercial purposes described in the section titled “Use of Personal Information,” and retain it pursuant to the section titled “Data Retention”.
We disclose the following categories of personal information for business or commercial purposes to third party service providers who perform business services for us, our business and advertising partners, and as part of our data broker services.

We do not collect any sensitive personal information from you within the scope of State Privacy Laws.
Rights to Your Information
In addition to the rights set forth in our Privacy Policy, State Privacy Laws may, depending on your state of residence, provide you with the following rights:
- Right to know. You may have the right to know whether we process your personal data and to access such personal data. You may also have the right to request that we disclose certain information to you about our collection, use, or disclosure of your personal information. If you are a resident of Delaware, you also have the right to obtain a list of the categories of third parties to which we have disclosed personal information of Delaware consumers.
- Right to data portability. You may have the right to obtain a copy of your personal data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another business without hindrance, where the processing is carried out by automated means.
- Right to delete. You may have the right to delete personal data that you have provided by or that we have obtained about you. Please note that we may deny such request if the requested deletion falls under an exception as set forth in the State Privacy Laws. Additionally, for residents of Colorado, Connecticut, and Texas, if you request deletion of your personal information and we have obtained such information from a third-party source, we may retain such data by keeping a record of the deletion request and the minimum data necessary to ensure that your personal information remains deleted from our records and that such retained data is not used for any other purpose, or we may opt you out of the processing of such personal information for any purpose except for those allowed under State Privacy Laws. Some State Privacy Laws, like those of Iowa and Utah, limit this right to only the data you have provided us.
- Right to correct. Unless you reside in Iowa or Utah, you may have the right to correct inaccuracies in your personal data, taking into account the nature of the personal data and the purposes for which we process it.
- Right to opt out. You have the right to opt out of the processing of your personal data for purposes of: (i) targeted advertising; (ii) the sale of personal data; or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you, unless you reside in Iowa or Utah. As of the latest date of the Privacy Policy:
- We DO process personal data or share it with third parties for the purposes of targeted advertising;
- We DO sell your personal data in exchange for monetary or other valuable consideration; and
- We DO NOT engage in profiling decision based on your personal data that produce legal or similarly significant effects concerning you.
If you wish to opt out of the processing of your personal data for any of the above purposes, or opt back in, please visit the web page Do Not Sell or Share My Personal Information. For residents of California, Colorado, Connecticut, Texas, Montana, New Hampshire, and elsewhere as required by State Privacy Laws, we will also treat opt-out preference signals as valid opt-out requests.
- Right to non-discrimination. You have the right not to receive discriminatory treatment by us for the exercise of your privacy rights. Unless permitted by the State Privacy Laws, we will not:
- Deny you goods or services;
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.;
- Provide you a different level or quality of goods or services.; or Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
How to Exercise Your Rights; Verifying Your Identity

After submitting a request, we will take steps to verify your identity in order for us to properly respond and confirm that it is not a fraudulent request. In order to verify your identity, we will ask, at a minimum, that you provide your name, mobile phone number, and email address, so that we can seek to match this information with the information existing in our systems. When providing us this information, you represent and affirm that all information provided is true and accurate. If we are unable to verify that the consumer submitting the request is the same individual about whom we have collected personal information, we may contact you for more information, or we may not be able to meet your request.
Only you (or for California, Colorado, Connecticut, Delaware, Nebraska, Montana, New Hampshire, New Jersey, Oregon, and Texas residents, an agent legally authorized to act on your behalf) may make a verifiable request related to your personal information. If you are making a request as the authorized agent of a California consumer, we will ask you also submit reliable proof that you have been authorized in writing by the consumer to act on such consumer’s behalf.
Response Time; Your Right to Appeal
We will make every effort to respond to your request within 45 days from when you contacted us. If you have a complex request, State Privacy Laws allow us up to 90 days to respond. We will contact you within 45 days from when you contacted us to inform you of the need for additional time and the reason for such extension. We may charge you a reasonable fee to cover administrative costs if your requests are manifestly unfounded, excessive, or repetitive.
If we decline to take action on a request that you have submitted, we will inform you of our reasons for doing so, and provide instructions for how to appeal the decision. Depending on your state of residence you may have the right to appeal within a reasonable period of time after you have received our decision. If you have this appeal right, within 60 days (45 days for residents of Colorado) of our receipt of your appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If we deny your appeal, we will provide you with a method for contacting your state attorney general’s office to submit a complaint.
California Privacy Rights
Under California Civil Code Section 1798.83 (“Shine the Light”), California residents may have the right to request in writing from businesses with whom they have an established business relationship: (a) a list of the categories of personal information, as defined under Shine the Light, such as name, email address, and mailing address, and the type of services provided to the customer that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes; and (b) the names and addresses of all such third parties. If you do not want your personal information shared with any third party who may use such information for direct marketing purposes, then you may opt out of such disclosures by sending an email to us at privacy@messagedigital.com.
Nevada Privacy Rights
If you are a resident of Nevada, you have the right to opt out of the sale of certain personal information that we have collected (or may collect) from you to other data brokers or other third parties. You can exercise this right by emailing us at privacy@messagedigital.com with the subject line “Nevada Do Not Sell Request.”
CHILDREN'S PRIVACY
The Services are intended for users ages 18 and over, and we do not knowingly collect personal information from children under the age of 18. When we become aware that personal information (or other information that is protected under applicable law) from a child under 18 has been collected, we will use all reasonable efforts to delete such information from our databases. If you believe we might have any personal information from or about a child under 18, please contact us by using the information the section below.
